Terms of Service

Section 01

About

Welcome to FlyStandby.app. This platform — the website at flystandby.app (the "Website") and the FlyStandby mobile application (the "App"), collectively the "Service" — is designed exclusively to support airline personnel with non-revenue travel logistics. Our services allow users to plan trips and exchange data regarding seat availability on commercial flights; use of the Service for any other reason is prohibited.

In this agreement, "FlyStandby," "we," and "us" encompass FlyStandby, its corporate affiliates, and related sites. "You" refers to any individual visiting the site or providing information.

Section 02

Agreement to Terms

Access to the FlyStandby Service is strictly conditional upon your full acceptance of the terms, notices, and conditions outlined below (the "Agreement") without modification. By accessing or using the Service, you acknowledge that you have read these terms and agree to be legally bound by them. If you do not agree, you are prohibited from using the Service.

Section 03

Modifications and Updates

We reserve the right to amend this Agreement at any time. Continued use following any change indicates acceptance. We indicate the date of the most recent update at the top of this page; changes become effective immediately on posting. For material changes we notify members via the email address on file or through a prominent notice. We encourage you to review this page regularly.

Section 04

Mandatory Acceptance

FlyStandby restricts access to users who have explicitly agreed to these terms. You will be presented with a dialogue on your initial login requiring you to accept this Agreement. If terms are updated, the dialogue reappears. Our user management system records and logs your confirmation.

Section 05

General Provisions

  1. 01Relationship of Parties. No joint venture, partnership, employment, or agency relationship exists between you and FlyStandby as a result of this Agreement or your use of the Service.
  2. 02Legal Compliance. Our performance is subject to existing laws and legal processes; nothing herein limits our right to comply with law-enforcement or governmental requests.
  3. 03Limitation on Claims. To the extent permitted by applicable law, any claim regarding your use of this Service must be commenced within two years after the cause of action arises.
  4. 04Severability. If any provision is found invalid or unenforceable, it will be replaced by a valid provision reflecting the original intent; the remainder remains in full force.
  5. 05Entire Agreement. This Agreement (including referenced policies) constitutes the entire agreement between you and FlyStandby and supersedes prior communications.
  6. 06Admissibility. A printed version of this Agreement and any electronic notice is admissible in judicial or administrative proceedings to the same extent as other business documents.
  7. 07Language and Storage. These Terms are available in the primary language of the Website. We do not store the specific version you agreed to; please save a copy for your records.
  8. 08Editorial Status. The Website is not updated on a fixed schedule and does not constitute an "editorial product" under press laws.
  9. 09Fictitious Examples. Any example company, product, or person names are fictitious and not intended to represent real entities.
  10. 10Reservation of Rights. Any rights not expressly granted in this Agreement are reserved by FlyStandby.
Section 06

Use of the Service

User Responsibilities

  • Accuracy — any information you submit is factual, precise, current, and comprehensive.
  • Security — you maintain the confidentiality of your credentials and prohibit access by others.
  • Authority — you have the legal capacity to enter this binding Agreement.

Right to Terminate

We may refuse service or restrict access at our sole discretion, particularly if you fail to comply with this Agreement.

Use of Content

You are prohibited from copying, reproducing, transmitting, posting, or redistributing any content, in whole or in part, without our express written consent.

Airline Verification

To affiliate your profile with your airline employer — required to contribute flight load information to the community — verify via your official airline email or by uploading a photo of your airline ID badge.

Account Restrictions

Single account per user. Sharing credentials is prohibited. Violations may result in suspension; remaining SkyCredits are forfeited.
Section 07

Prohibited Activities

All assets on the Service — text, imagery, audio, software, code, flight data, and underlying infrastructure — are the exclusive property of FlyStandby. You agree not to reproduce, distribute, modify, license, sell, or create derivative works from any material or services found herein. You also agree to refrain from:

  • Commercial Use — using the Service or its data for any commercial or revenue-generating purpose.
  • Automated Access — robots, spiders, scrapers, or manual processes to access, monitor, or copy content without written consent.
  • Circumvention — violating robot exclusion headers or bypassing access measures.
  • Server Load — actions placing an unreasonable load on our infrastructure.
  • Deep-Linking — linking to specific internal pages without express written permission.
  • Framing — mirroring, framing, or embedding any part of the Service without authorisation.
  • Reverse Engineering — decompile, disassemble, modify, or reverse engineer any associated software or code.
Section 08

Privacy

The privacy terms here align with the full Privacy Policy. We collect visitor details to operate the Service and fulfil agreements with you. By accepting these Terms you consent to the use of necessary cookies. Manage cookie preferences via our Cookie Policy.

Your data may be used for:

  • Support — responding to your inquiries.
  • Updates — notifying you of contests, campaigns, or promotions (opt-in).
  • Personalisation — tailoring website content to your preferences.
  • Administration — processing transactions and payments.
  • Security & Law — preventing fraud and complying with lawful requests.

We will never sell your personal data. To measure the effectiveness of our own advertising, we share a limited set of conversion data with Meta: a hashed email address, our internal user ID, and — where you arrived from an ad — the identifier attached to that click.

In the EEA, the UK and Switzerland this happens only if you opt in — by accepting marketing cookies on the Website, or by allowing tracking when the App asks. Elsewhere it is active by default and you can switch it off at any time, from the cookie settings on the Website or under Preferences, in the Privacy section, in the App. We never share your itineraries, your load data, or your name.

Section 09

User Content and Communication

Submissions & License

By submitting any content (email, postings, feedback, suggestions — collectively "Submissions") you grant FlyStandby and its affiliates a non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sub-licensable worldwide licence to use, reproduce, modify, translate, distribute, publish, and publicly display the Submission in any media. We may use the name submitted unless you have opted for anonymity.

Load Information Policy

The exchange of commercial non-revenue seat-load information is restricted exclusively to the designated Request System. Use of other parts of the Service for this purpose is grounds for immediate account termination.

Prohibited Content

  • — Defamatory, obscene, harassing, threatening, fraudulent, or otherwise objectionable content.
  • — Hate speech, racism, bigotry, or content promoting harm.
  • — Instructions or encouragement of criminal offences; privacy violations; viruses.
  • — Patent, trademark, copyright, or trade-secret infringement.
  • — Impersonation of any person or entity.
  • — Spam, junk mail, political campaigning, unauthorised sales/advertising.
  • — Third-party private data (addresses, SSNs, card numbers).
  • — Viruses, corrupted data, hidden/password-restricted pages.
  • — Content you are not authorised to redistribute.

Content Monitoring

We have no obligation to screen Communication Channels but reserve the right to review, translate, edit or remove any content at our discretion, at any time, without notice. You are responsible for maintaining backups of your content.

Waiver of Moral Rights

  • — You do not require personally identifying info to be associated with your content.
  • — You have no objection to publication, modification, deletion, or exploitation.
  • — You waive any claim to moral rights regarding the Content.
  • — You release FlyStandby and its successors from any moral-rights claims.
Section 10

SkyCredits

SkyCredits serve as the virtual currency for requesting non-revenue flight loads and accessing other interactive services on FlyStandby.

Load Request

200 SkyCredits per request or update.

Flight Status

20 SkyCredits per lookup.

Route Explorer

20 SkyCredits per search.

Trip Creation

100 SkyCredits after the first 3 free trips.

Journey Creation

400 SkyCredits after the first free journey.

Priority Bidding

Optional. Users may voluntarily bid additional credits above the base fee to increase load-request priority.

Automatic Returns

If a flight departs without your load request receiving an answer, the SkyCredits you spent are returned to your balance. This is a product feature, not a refund of money paid — see Right of Withdrawal.

Acquisition

Welcome bonus 200 SkyCredits on registration; +800 on airline-employee verification. The welcome bonus is a one-time benefit per user and is not granted again if you delete your account and register again. Additional SkyCredits are available through referral rewards or by purchasing packages via the Website (Stripe) or in-app (Apple). FlyStandby may change, reduce, suspend or withdraw any promotional or welcome bonus, including amounts and eligibility, at any time and without prior notice. Bonus amounts already credited to your balance are not affected.
Free Tier. All users get 3 trips and 1 journey lifetime, plus unlimited free flight searches across all airlines. Route Explorer and Flight Status lookups are charged per use unless covered by a subscription.
Restrictions, refunds and expiration. SkyCredits are digital content delivered immediately on payment. At checkout you expressly request immediate delivery and acknowledge that you waive your 14-day right of withdrawal under Article 16(m) of Directive 2011/83/EU. As a result, purchased SkyCredits are non-refundable, including any portion you have not yet spent. SkyCredits hold no cash value and cannot be exchanged for money. App Store purchases are processed by Apple under their own refund policy. SkyCredits do not expire, but FlyStandby reserves the right to amend these terms. If FlyStandby discontinues the Service, all outstanding credits are deemed null and void without refund. Full rules in the Right of Withdrawal policy.
Section 11

Subscription Plans

FlyStandby offers optional plans ("Pro" and "Max") on a monthly or yearly cycle, available via the Website (Stripe) or App Store (Apple).

Pro Plan

3 free trips + 1 additional/month · 1 free journey + 1 additional/month · 10 free route/status searches/month.

Max Plan

Unlimited trips · unlimited journeys · unlimited route/status searches · automatic Platinum loyalty status.

Auto-Renewal

Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.

Cancellation

Cancel any time. Cancellation takes effect at the end of the current billing period; access continues until that date.

Refunds

Subscription access activates immediately on payment or trial start. At checkout you expressly request immediate access and acknowledge that you waive your 14-day right of withdrawal under Article 16(a)/16(m) of Directive 2011/83/EU. The amount paid for the current billing period is non-refundable, including if you stop using the service before the period ends. See the Right of Withdrawal policy.

Price Changes

We may adjust pricing with at least 30 days' advance notice. Continued use after the effective date constitutes acceptance.

Apple Subscriptions

Subscriptions purchased on iOS are billed through your Apple ID. Your account is charged at confirmation of purchase and again within 24 hours before each renewal. Auto-renewal can be turned off, and active subscriptions managed or cancelled, in your Apple ID account settings at least 24 hours before the end of the current period. Cancellation and refund requests for App Store purchases must be directed to Apple under their terms.

Downgrade

Trips, journeys, or data created during your subscription remain accessible after cancellation; you may not create new ones beyond the free-tier allowances.
Section 12

Indemnification

You agree to defend, indemnify, and hold FlyStandby — including affiliates, officers, directors, employees, and agents — harmless from any claims, liabilities, damages, or expenses (including legal and accounting fees) asserted by third parties arising from:

  • — Your failure to comply with this Agreement or any documents linked herein.
  • — Your violation of any law or infringement of a third party's rights.
  • — Your general use of the Service.
Section 13

Third-Party Websites

The Service may link to external sites not owned or operated by FlyStandby. We exercise no control and assume no responsibility for their content, privacy policies, or practices. Inclusion of a link does not imply endorsement. You are responsible for taking necessary precautions to ensure links and downloads are virus-free.

Some third-party services may offer the option to link your FlyStandby profile with their platform. This is optional; you may disconnect at any time via the third-party site.

Section 14

Software

Geographic Scope

FlyStandby operates the Service from its headquarters in Belgium. Materials are intended to promote our services and partners; we make no representation that they are appropriate for use outside the EU. If you access from outside the EU you do so on your own initiative and are responsible for local-law compliance.

Software Licensing

Any software available for download is the copyrighted work of FlyStandby, its affiliates, or third-party providers. Use is governed by the accompanying End User License Agreement, or — if none — by a limited, personal, non-transferable licence for the sole purpose of viewing and navigating the Service.

IP & Restrictions

All underlying code is proprietary and protected by copyright laws and international treaties. Unauthorised reproduction or redistribution is prohibited and may carry civil and criminal penalties. Copying to another server for further reproduction or redistribution is forbidden.
Section 15

Copyright and Trademarks

  • Copyright. All content is the exclusive property of FlyStandby. All rights reserved. We assume no liability for content on external third-party sites.
  • Trademarks. The FlyStandby name, the "SkyCredits" system, and our logos, slogans, and product names are registered or common-law trademarks. You may not copy, imitate, or use them without prior written consent.
  • Trade Dress. The visual identity of the Service — page headers, custom graphics, button icons, scripts — constitutes our "trade dress." Imitation is prohibited without written permission.
  • Third-Party Rights. All other company, product, and logo names remain the property of their respective owners.
  • Notice & Takedown. If you believe specific material infringes your copyright, contact us immediately.
Section 16

Modifications to Service

Updates to Terms

We may update, modify, or remove portions of these Terms at our discretion. Continued use after changes are made expressly binds you to the updated Terms.

Service Availability

We may modify, suspend, or discontinue any aspect of the Service — content, features, or database availability — at any time.

Access Restrictions

We may limit specific features or restrict your access without prior notice or liability for technical or security reasons, to prevent unauthorised access, or where we determine that you have violated these Terms or applicable laws.
Section 17

Jurisdiction

Governing Law

The Service is operated by a private individual resident in Belgium. This Agreement is governed by the laws of Belgium. You consent to the exclusive jurisdiction and venue of the courts in Brussels, Belgium for all disputes arising out of or relating to use of this Service.

Dispute Resolution

All claims must be heard and resolved in a court of competent subject-matter jurisdiction located in Belgium. Use of this Service is unauthorised in any jurisdiction that does not give effect to all provisions of these terms.

Consumer Rights Exception

The foregoing does not apply to the extent that applicable law in your country of residence requires the application of another law and/or jurisdiction and that requirement cannot be excluded by contract.
